The 2024 Chefman SuiteStakes Official Rules

Introduction

By entering into this Chefman (the “Sponsor”) SuiteStakes (the “Sweepstakes”), participant (the “Participant”) agrees to abide by these official rules.

No purchase necessary to enter or win. Purchase of Sponsor products or services does not enhance chances of winning.

Date

Sweepstakes begins at 12:00:01am Eastern Time (“EDT”) on September 23, 2024 and ends at 11:59:59pm EDT on October 7, 2024 (the “Sweepstakes Period”).

Eligibility

Sweepstakes is open only to legal residents of the fifty (50) United States, the District of Columbia or Puerto Rico, who are 18 years of age or older at the time of entry (the “Entrant”). Employees, officers, directors, or agents of Sponsor or any of Sponsor’s partners, related companies, agencies, or agents, as well as the immediate family (defined as spouse, parents, siblings, children, and grandparents) and same household members of any such employee, officer, director, or agent, are not eligible to participate. All applicable federal, state, and local laws and regulations apply. Void where prohibited or restricted by law.

How to Enter

Entrants should submit an entry form during the Sweepstakes Period on the Sponsor’s website at https://chefman.com/pages/chefman-suitestakes-2024 (the “Website”) to receive one (1) entry into the Sweepstakes. Entrants will have a limit of 1 entry per Entrant for the entire Sweepstakes Period. 

Sponsor will not consider incorrect, fraudulent, incomplete, late, or otherwise non-conforming entries or entries that are intended to annoy, abuse, threaten, or harass any person or entity in any way. All entries, once provided, are Sponsor’s sole and exclusive property. Eligibility is at the exclusive discretion of Sponsor, and Sponsor shall be entitled to reject any entrant for any reason or no reason at all without having to provide an explanation. Sponsor reserves the right, in its sole discretion, to cancel, suspend, or terminate the Sweepstakes for any reason and without prior notice to any Participant. In such instance, Sponsor may, if and as appropriate, select a winner using reasonable means that are materially consistent with the Sweepstakes in question.

Drawing 

On or about October 8, 2024, one winner will be selected in a random drawing from all eligible entries received by the Sponsor. Odds of winning depend on the number of eligible entries received for the Sweepstakes. To be eligible to receive a prize, all Entrants must have an address on file with the Sponsor or have provided an address when prompted at the time of entry. In the event that an Entrant has an incomplete address, the Entrant will be disqualified and an alternate prize winner will be selected in a random drawing.

Prize

One (1) prize will be awarded, consisting of a Sponsor’s product. Prizes will not be substituted by Sponsor for cash or other merchandise pursuant to any prize winner’s request. Sponsor, however, reserves the right to substitute alternate Prizes of comparable or equal value in its sole discretion. Subject to applicable law, prizes are offered “as is” without any express or implied warranty of any kind or nature, including without limitation, any warranty respecting condition, merchantability, quality, title, or fitness for a particular purpose. 

Notifications/Claims

The winner will be announced on the Website on or about October 8, 2024 (the “Notification”). The prize will be mailed within 14 days using the United States Postal Service Priority Mail. If it is determined by Sponsor, in its sole discretion, that a potential winner is not eligible in accordance with these Official Rules, an alternate winner will be selected at random from among the remaining non-winning eligible entries received during the Sweepstakes Period.

In the event the prize is returned, the address is insufficient or incomplete for shipping purposes, or undeliverable for any reason, the prize winner will be disqualified, and an alternate winner will be selected from the remaining eligible entries received.

Conditions

All federal, state and local taxes are the sole responsibility of the prize winner. Neither Sponsor nor anyone acting on its behalf will enter into any communications with any Entrant regarding this Sweepstakes, except as expressly set forth in these Official Rules. By participating in this Sweepstakes, Entrants, and prize winner release the Sponsor and each and all of the Sweepstakes Entities, from any and all liability, damages or causes of action (however named or described) with respect to or arising out of participation in the Sweepstakes, and/or the receipt or use/misuse of any prize awarded, including, without limitation, liability for personal injury, death or property damage. Failure to comply with these Official Rules may result in disqualification from the Sweepstakes. All Sweepstakes materials are subject to verification and are void if they contain printing, typographical, mechanical, or other errors. Entrants assume all risk of loss, damage, destruction, delay or misdirection of Sweepstakes materials submitted to Sponsor. In the event any portion of this Sweepstakes is compromised by activities beyond the control of the Sponsor which, in the sole opinion of the Sponsor, corrupt or impair the administration, security, fairness or proper play of the Sweepstakes or this Sweepstakes, Sponsor reserves the right at its sole discretion to modify, suspend or terminate the Sweepstakes. Winning a prize constitutes permission for Sponsor to use prize winners' names, addresses (city & state), voices and/or likenesses for purposes of advertising, promotion and publicity, for this Sweepstakes only, without further compensation, unless prohibited by law. Sponsor may prohibit an Entrant from participating in the Sweepstakes or winning a prize if, in its sole discretion, it determines that said Entrant is attempting to undermine the legitimate operation of the Sweepstakes by cheating, deception, or other unfair playing practices (including the use of automated quick entry programs) or intending to annoy, abuse, threaten or harass any other Entrants or Sponsor. If for any reason this Sweepstakes is not able to be conducted as planned, including, but not limited to, by reason of infection by computer virus, bugs, tampering, unauthorized intervention, fraud or any other causes beyond the reasonable control of Sponsor which corrupt or affect the administration, security, fairness, integrity or proper conduct of the Sweepstakes, then Sponsor reserves the right at its sole discretion to cancel, terminate, modify or suspend the Sweepstakes and randomly draw from those entries received up to the cancellation/suspension date to award prizes. 

No Liability

By participating, Entrants and prize winners agree to release, discharge, indemnify and hold harmless the Sponsor, and each of its officers, directors, employees, representatives and agents (collectively, the “Released Parties”) from and against any claims made by any Entrant, prize winner, or any other third parties, related in any way to the operation of this Sweepstakes as well as any other claims, damages or liability due to any injuries, damages or losses to any person (including death) or property of any kind resulting in whole or in part, directly or indirectly, from receipt, acceptance, possession, misuse or use of a prize or participation in any promotion related activity or participation in this Sweepstakes.

Use of Data

Sponsor will be collecting personal data about Entrants online, in accordance with its Privacy Notice. Please review the Sponsor’s Privacy Notice at https://chefman.com/pages/privacy-policy. By participating in the Sweepstakes, Entrants hereby agree to Sponsor’s collection and usage of their personal information and acknowledge that they have read and accepted Sponsor’s Privacy Notice.

Dispute Resolution

The parties hereto acknowledge and agree that: (1) all disputes, causes of action, and claims connected to or arising in any way hereunder between the parties shall be resolved solely on an individual basis (i.e., class actions suits are hereby waived by the parties), and exclusively by the state or federal courts situated in Bergen County, New Jersey; (2) the laws of the state of the State of New Jersey shall govern, without regard to its conflict of laws principles; and (3) the parties hereto waive any right to a trial by jury.

This Sweepstakes shall not be published without the written permission of the Sponsor.
